Acceptance and Scope

These Terms of Use apply to your use of Menugo and related services. By using the service, you agree to these terms.

Service Availability and Changes

Menugo is provided on an “as is” and “as available” basis. We may add, modify, suspend, restrict, or discontinue features, providers, content, or advertising at any time when reasonably necessary for business, legal, security, or operational reasons. If we discontinue the service, we will give notice by reasonable means where practicable, and will first stop new purchases and any automatic renewals where applicable. Where valid subscriptions remain, we will endeavor to keep the service available through the end of the relevant term when reasonably possible. If we cannot provide the service during an active term, refunds and other remedies will follow Apple's refund procedures and applicable law.

Paid Passes and Billing

Menugo offers non-renewing 7-day and 30-day passes at launch; 90-day, annual, and lifetime plans are not sold at launch. Prices, duration, and included features are shown in the app before purchase.

Charges are billed to your Apple Account when you confirm the purchase. Purchase, renewal, cancellation, and refunds are handled under the Apple App Store payment system, Apple's terms and procedures, and applicable law. You can cancel from the Apple ID subscription management screen when available. These passes end automatically at the end of the purchased period and do not renew automatically.

Credits and Usage Limits

Credits, usage quotas, counts, minutes, and similar units are units for using eligible features in the Menugo app.

Credits are not cash, electronic money, prepaid payment instruments, or any other form of monetary value.

Credits may not be transferred to third parties, exchanged for money, refunded, or used outside the app.

For operational, technical, external API cost, legal, or specification-change reasons, we may change future credit grants, credit consumption, or usage limits. If a change materially disadvantages you, we will provide advance or prompt notice by reasonable means.

Translation, AI Output, and Important Information

Menugo provides AI-assisted translations and related convenience features. Translation accuracy, completeness, and suitability cannot be guaranteed. Important information, including menu contents, ingredients, allergy information, prices, reservations, directions, health-related statements, and legal or financial matters, must be confirmed directly with the relevant restaurant, venue, service provider, or other authoritative source.

Allergies, Dietary Restrictions, and Religious Restrictions

Menugo's display is for translation and presentation assistance only. It does not guarantee food safety, the presence or absence of ingredients, contamination during preparation, or suitability for allergy management, dietary restrictions, or religious restrictions.

Before ordering, eating, purchasing, visiting, or making any other decision, users must confirm directly with restaurant staff, product labels, official information, or other reliable sources.

If you feel unwell or the situation is urgent, seek advice from a medical institution or emergency services immediately.

Third-Party Services and Dependencies

Some features of Menugo rely on third-party services such as Apple, Google, OpenAI, Groq, AWS, and AdMob.

If a third-party service changes its specifications, fails, stops operating, or changes its fees or terms, some features may become unavailable or limited.

Where reasonably possible, we may provide an alternative, limit features, adjust usage caps, or provide notice.

User Responsibilities

User Content, Reports, and Moderation

Menugo may host user reviews, photos, comments, or similar content. We may review, restrict, hide, block, or remove content, and may limit access to accounts or features, when content appears unlawful, abusive, fraudulent, misleading, dangerous, infringing, or otherwise inconsistent with our rules or legal obligations.

User Content License

If you submit reviews, photos, comments, or other content to Menugo ("User Content"), you grant Menugo a non-exclusive, royalty-free, transferable, sublicensable license to use the User Content as reasonably necessary to provide, display, store, back up, moderate, handle reports, comply with law, enforce these Terms, and operate the service.

You represent that you have the rights necessary to submit the User Content and that it does not infringe any third-party rights, including copyright, portrait rights, privacy rights, or trademark rights.

Menugo may review, restrict, hide, block, remove, store, reposition, or otherwise process User Content as needed for service operation, user protection, report handling, legal compliance, or rights protection.

Prohibited Conduct

Intellectual Property

The service, excluding user-submitted content, is owned by Menugo or its licensors and protected by applicable intellectual property laws.

Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Menugo disclaims warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law, Menugo will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from or related to your use of the service.

To the extent liability arises from ordinary negligence and is not caused by our intent or gross negligence, our liability is capped at the amount you actually paid for the service during the one month preceding the time the damage occurred.

This cap does not apply to damages caused by our intent or gross negligence, damages to life or body, or any case where applicable law does not permit limitation of liability.

Nothing in these terms excludes or limits liability, consumer rights, or other protections that cannot be excluded under applicable law.

Governing Law and Contact

These terms are governed by Japanese law except to the extent mandatory local law provides otherwise. For questions about these terms, contact japangourmet.app@gmail.com. Except where otherwise required by law, any dispute arising from these terms shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.
